Authorized Representation for Distant Sellers outside Türkiye
New WEEE, Battery and Packaging Regulations has been prepared with the definition Authorized Representation to include distant-sellers in terms of Waste Management Obligations.
Who is in Scope?
Natural or real person who, irrespective of the method of sale, including sales made through distance contracts:
Producers who are resident in another country and sells products directly to consumers/end-users in Türkiye via remote communication.
These producers need to appoint an Authorized Representative to fulfil their obligations.
The definition of Authorized Representative is:
The real or legal person residing in Türkiye who is assigned in writing by the manufacturer to fulfill some of the manufacturer’s obligations under this Law and other relevant legislation on behalf (Regulation Nr. 7223 Product Safety and Technical Regulations Law)
Duty of Authorized Representative on behalf of Producer
- The manufacturer may appoint an authorized representative by specifying the nature, conditions and limits, if any, of the delegated powers and duties in writing and clearly.
- The authorized representative fulfills the duties assigned by the manufacturer as not limited by the legislation. However, even if it is not specified in the assignment document, the authorized representative retains the documents required by the technical regulation and showing the conformity of the product for at least ten years from the date the product is placed on the market, in cases where the period specified in the technical regulation is not specified, and, upon request of the authorized institution, in Turkish or in other languages accepted by the authorized institution. provides in one language. The AR promptly fulfills the instructions of the authorized institution in the activities carried out in order to eliminate the risks of the product.
- Register on Online System of The Ministry of Environment (WEEE, Battery and Packaging); report Put On Market and Collection Amounts yearly.
- Register on Online System of Ministry of Finance; report distant sales amount and pay Recovery Participation Fee (GEKAP) quarterly.
